 Dictionary: Probation. Definition and Concept

The problem of defining probation is difficult and important. It is difficult because, as many specialist show (Kalmthout & Derks, 2000; Demers, 1997; Hamai and others, 1995) probation represent an open concept which is flexible for contextual interpretations. This is the reason why many countries use the term of probation, but analyzing their legislation we can notice that in some countries probation mean an extensive area of interventions, such as evaluation report making, offering of alternatives for classical justice or just preventive arrest, assisting detainees before and after liberation, etc., and probation refers strictly on surveilling the criminals maintained in a state of freedom by a Court with the condition to respect certain measurements or obligations.
