nternational migration of people takes place in accordance with a set of norms established by national and international regulations and based on a legislative and institutional framework designed to coordinate and limit human mobility. Migration policies and legal regulations contain provisions regarding border control, the right to free movement, visa granting procedures, residency conditions and socio-economic integration policies in the host society. The phenomenon of external migration is interpreted differently depending on the institutional or societal perspective, being perceived either as an element of development or as a challenge that puts pressure on security systems, social cohesion and national identities. Faced with such circumstances, states have the prerogative to institute temporary restrictions on freedom of movement, if they are legally substantiated and applied in a legitimate and proportionate manner. These measures are ordered by court decision, and the related information is communicated to the relevant authorities and institutions in the application of the legal regime of international movement. The Romanian Criminal Code provides, within the legal institutions intended for the judicial individualization of the execution of criminal sanctions, a series of measures that limit the right to free movement. Among such measures, the obligation of the person subject to criminal sanctions not to leave the territory of Romania constitutes a temporary prohibition. Courts are called upon to analyze the justified and proportional nature of such a restrictive measure not only at the time of the judgment, but also during its execution.
